ATAKDOMAIN.COM DOMAIN REGISTRATION AGREEMENT

  1. OVERVIEW

This Domain Registration Agreement (this “Agreement”) is entered into by and between you and Atak Domain Bilgi Teknolojileri A.Ş. (ATAK DOMAIN) and shall be effective as of the date of your electronic acceptance. This Agreement sets forth the terms and conditions applicable to your use of ATAK DOMAIN’s domain name registration services. The terms “we”, “us”, or “our” shall refer to ATAK DOMAIN. The terms “you”, “your”, “User” or “customer” shall refer to the individual or legal entity accepting this Agreement. Unless expressly stated otherwise, no provision of this Agreement shall be deemed to confer any rights or benefits on any third party.

By this Agreement, you acknowledge and agree that:

(i) ATAK DOMAIN, in its sole discretion, may change this Agreement and the policies or agreements referenced herein at any time, and such changes or modifications shall be effective immediately upon posting on the Site, and (ii) your use of this Site or the Services provided on this Site after such changes or modifications have been made shall constitute your acceptance of this Agreement as last revised. If you do not agree to be bound by this Agreement as last revised, do not use (or continue to use) this Site or the Services available on this Site. In addition, ATAK DOMAIN may, from time to time, notify you by email of changes or modifications made to this Agreement. Therefore, it is very important that you keep your customer account (“Customer Account”) information, including your email address, up to date. ATAK DOMAIN assumes no liability or responsibility if you do not receive notification by email because of an inaccurate or outdated email address. ATAK DOMAIN is an ICANN-accredited domain name registrar.

You acknowledge and agree that ATAK DOMAIN may modify this Agreement to comply with the terms and conditions imposed (i) by ICANN and/or (ii) by the applicable registry for the relevant top-level domain (“TLD”) or country-code top-level domain (“ccTLD”). The term “Registry Service Provider” refers to the service provider responsible for operating and managing the registry services on behalf of the Registry Operator for the relevant TLD or ccTLD.

  1. SPECIAL PROVISIONS APPLICABLE TO ALL REGISTRATIONS

Unless otherwise stated, the provisions of Section 2 below apply to all TLDs that we offer. Special provisions applicable to specific TLD or ccTLD domain names are set out in the subsequent sections of this Agreement.

  1. Registration Policies. You agree to be bound by all applicable Registration Policies (as defined above in this Agreement) applicable to the registration of your domain name. Notwithstanding any other provision of this Agreement, the Registry Operator for the TLD in which the domain name is registered is an express third-party beneficiary of this Agreement and shall remain such. Accordingly, the parties to this Agreement acknowledge and agree that third-party beneficiary rights are granted to the Registry Operator, and that the Registry Operator acts in reliance on such third-party beneficiary rights granted under this Agreement by entering into an arrangement with ATAK DOMAIN to operate as the registry for the relevant TLD. The Registry Operator’s third-party beneficiary rights shall not be extinguished by any termination of this Agreement.
  2. Registration Requirements. If any TLD or ccTLD requires certain eligibility (e.g. residency for .JP, .EU, etc.), validity (e.g. DNS validation) or other verification requirements as a condition to registering a domain name in that TLD, then by submitting an application, registering or renewing a domain name in such TLD, you (a) represent and warrant that all information provided (including all supporting documents, if any) for the registration or renewal of the domain name is accurate, complete, not misleading in any way, and that the application is submitted in good faith; (b) represent and warrant that throughout the entire term of the domain name registration you meet and will continue to meet the eligibility criteria set forth in the Registration Policies for the applicable TLD; (c) represent and warrant that you have not previously submitted an application for the same eligibility criteria for the domain name to another domain name registrar that has been rejected by such registrar (if applicable); (d) acknowledge and agree that even if the domain name is accepted for registration, your ability to register and use the domain name may be challenged by other persons asserting rights in respect of the domain name; and (e) acknowledge and agree that if any of the required representations is found to be false, incomplete or misleading, the Registry or registrar may cancel the registration of the domain name.
  3. Misleading Content, Trademark Infringement and Imitation Sites Not Permitted. The User may not host, on any registered domain, any content that impersonates third parties or organizations; infringes a trademark, trade name or service name; or is misleading, false or fraudulent in nature. In such cases, Atak Domain reserves the right to suspend the domain and to notify the competent authorities.
  4. Ownership. You acknowledge and agree that any registration of a domain name does not create any property or ownership right in the name used as a domain name or in the domain name registration itself for you, the registrar, or any other person, and that the entry of a domain name into the registry maintained by the registrar shall not be construed as evidence of ownership or as proof of any right in the registered domain name. You shall not under any circumstances transfer or attempt to transfer any ownership right in any domain name registration, or transfer or attempt to transfer a domain name registration as security, or otherwise encumber or attempt to encumber a domain name registration by way of pledge or security interest.
  5. ICANN Requirements. You further agree to be bound by the requirements, standards, policies, procedures and practices of ICANN which ICANN monitors for compliance in accordance with the Registry Agreement between ICANN and the applicable Registry Operator and any other arrangements between ICANN and such Registry Operator.
  6. Indemnification of the Domain Name Registrar. You agree to indemnify, defend (within thirty (30) days of any claim) and hold harmless the Registry Operator, the Registry Service Provider and their subcontractors, affiliates, partners, divisions, shareholders, directors, officers, employees, accountants, attorneys, insurers, agents, predecessors, successors and assigns from and against any and all claims, demands, damages, losses, costs, expenses, causes of action or other liabilities of any kind, whether known or unknown, including reasonable legal and attorneys’ fees, arising out of or in any way related to your domain name registration, including, without limitation, the use, registration, extension, renewal, deletion and/or transfer of the domain name and/or any breach of applicable terms, conditions or requirements relating to the registration. You shall not enter into any settlement or mediation of any indemnifiable claim without the prior written consent of the domain name registrar or Registry Operator, which consent shall not be unreasonably withheld, and you acknowledge that this indemnification obligation shall survive any termination or expiration of this Agreement for any reason. In no event shall the Registry Operator be liable to you or any other person for any direct, indirect, incidental, consequential, special, exemplary or punitive damages, including, without limitation, loss of profits, loss of business reputation, or loss of data or files, arising from or related to your inability to use the domain, whether such liability is asserted in contract, tort (including negligence) or otherwise, even if the Registry Operator has been advised of the possibility of such damages.
  7. Regulated TLDs. For any “Regulated” TLD, you acknowledge and agree that your registration is subject to the following additional requirements: (a) you must comply with all applicable laws, including, but not limited to, those relating to privacy, data collection, consumer protection (including those relating to misleading or deceptive conduct), fair credit reporting, debt collection, organic farming, data disclosure and financial disclosures; (b) if you collect and store sensitive health- or finance-related data, you must implement reasonable and appropriate security measures proportional to the services provided, as defined by applicable law. Regulated TLDs include, but are not limited to: .games, .juegos, .school, .schule, .toys, .eco, .care, .diet, .fitness, .health, .clinic, .dental, .healthcare, .capital, .cash, .broker, .claims, .exchange, .finance, .financial, .fund, .investments, .lease, .loans, .market, .money, .trading, .credit, .insure, .tax, .mortgage, .degree, .mba, .audio, .book, .broadway, .movie, .music, .software, .fashion, .video, .app, .art, .band, .cloud, .data, .digital, .fan, .free, .gratis, .discount, .sale, .media, .news, .online, .pictures, .radio, .show, .theater, .tours, .accountants, .architect, .associates, .broker, .legal, .realty, .vet, .engineering, .law, .limited, .show; .theater; .town, .city, .reise,.reisen,.coop,.bank,.aero,.travel.
  8. Highly Regulated TLDs. In addition to the requirements applicable to Regulated TLDs, registrations in Highly Regulated TLDs are subject to the following requirements: (a) you shall provide and keep up to date the contact information of an administrative contact person as well as the contact details for your principal place of business, as required by applicable law or by relevant self-regulatory bodies in the sector, for the purposes of receiving complaints or reports of abuse of registrations; (b) you represent that you have the necessary authorizations, privileges, licenses and/or other relevant credentials required to participate in the sector associated with the relevant Highly Regulated TLD; and (c) you agree to comply with all applicable regulations and licensing conditions, promptly notify of any material changes to the validity of your authorizations, privileges, licenses and/or other credentials relating to participation in the sector associated with the relevant Highly Regulated TLD, and generally continue to operate in the area of interest of consumers served by such TLD. Highly Regulated TLDs include, but are not limited to: .abogado, .attorney, .bank, .bet, .bingo, .casino .charity (and the IDN equivalent xn--30rr7y), .cpa, .corp, creditcard, .creditunion .dds, .dentist, .doctor, .fail, .gmbh, .gripe, .hospital, .inc, .insurance, .lawyer, .lifeinsurance, .llc, .llp, .ltda, .medical, .mutuelle, .pharmacy, .poker, .university, .sarl, .spreadbetting, .srl, .sucks, .surgery .university, .vermogensberater, .vesicherung and .wtf.

For the .doctor TLD, domain name registrants who represent themselves as licensed healthcare professionals must, upon request, demonstrate to the Domain Name Registrar and the Registry Operator that they hold the relevant professional license.

  1. Military TLDs with Special Security Requirements. In addition to the requirements applicable to Regulated and Highly Regulated TLDs, by registering a domain name in a “Military” TLD with special security requirements, you agree to take reasonable steps to avoid creating a false impression or implying that you or your business are associated with, sponsored by, or endorsed by the armed forces of one or more countries where no such relationship, sponsorship or endorsement exists. Military TLDs with special security requirements include: .army, .navy, .airforce
  2. Third-Party Beneficiary. Notwithstanding any other provision of this Agreement, the Registry Operator for the TLD in which the domain name is registered is an express third-party beneficiary of this Agreement and shall remain such. Accordingly, the parties hereby acknowledge and agree that third-party beneficiary rights are granted to the Registry Operator, and that the Registry Operator acts in reliance upon such third-party beneficiary rights under this Agreement by entering into an arrangement with ATAK DOMAIN to operate as the domain name registry for the relevant TLD. The Registry Operator’s third-party beneficiary rights shall not be extinguished by any termination of this Agreement.
  3. Variable and Non-Uniform Pricing. You acknowledge, understand and agree that certain domain names in certain TLDs may be designated under the Registration Policies as having variable pricing (e.g., standard vs. premium names) and/or may have non-uniform renewal pricing.
  4. Restrictions on Privacy or Proxy Registrations. You acknowledge and agree that in certain markets, countries, regions, or for certain TLDs, you may not be permitted to purchase private or proxy domain registrations. In such cases, all TLD registrations must be made using your own personal information, which you represent and warrant to be accurate, up to date, and complete.
  1. REGISTRATION AND PAYMENTS

You agree to pay all prices and fees charged for Services you order, purchase or otherwise acquire on this Site. ATAK DOMAIN reserves the right to change or modify its prices and fees at any time, and such changes or modifications shall be posted online on this Site and become effective immediately without further notice to you. If you purchase or obtain Services for a fixed term (for example, for a month or a year), any changes or modifications in prices and fees will take effect upon renewal of such Services, as described in detail above.

3.1 DOMAIN RENEWAL TERMS

All renewals are subject to the terms of this Agreement (as amended from time to time), and you acknowledge and agree that all renewed domain names will be subject to the terms of this Agreement (as amended). Domain renewal fees are non-refundable. If, for any reason, ATAK DOMAIN is unable to obtain payment from your stored Payment Method and you fail to respond to our notices, your domain name registration will expire.

You must renew certain ccTLD extensions (such as .am, .at, .be, .br, .ca, .cn, .com.cn, .net.cn, .org.cn, .de, .eu, .fm, .fr, .gs, .it, .jp, .ms, .nu, .nz, .co.nz, .net.nz, .org.nz, .tc, .tk, .tw, .com.tw, .org.tw, .idv.tw, .uk and .vg) at least 15 days before their expiration date.

You acknowledge that ATAK DOMAIN shall not be responsible for cancelled domain names that you fail to renew within the time periods specified in this Agreement. If you fail to renew your domain name in a timely manner, additional fees may apply. If you have registered privacy services, protected registration or any other similar service along with your domain name registration, such services will also be automatically renewed when your domain registration is renewed, unless you cancel them in advance, and you will be charged the applicable additional renewal fees.

If you do not renew your domain name within the time periods specified in this Agreement, you acknowledge that ATAK DOMAIN, at its sole discretion, may choose to renew an expired domain name on your behalf. If ATAK DOMAIN decides to renew an expired domain name on your behalf, a Renewal Grace Period will apply, during which you may retain the domain name by paying ATAK DOMAIN its renewal fees. The Renewal Grace Period is currently twelve (12) days, but is subject to change in accordance with this Agreement.

For certain ccTLDs (.am, .at, .be, .cn, .com.cn, .net.cn, .org.cn, .de, .eu, .fm, .fr, .gs, .it, .jp, .ms, .nu, .nz, .co.nz, .net.nz, .org.nz, .tc, .tk, .tw, .com.tw, .org.tw, .idv.tw, .uk and .vg), a Renewal Grace Period is not provided after the expiration date of the domain name. If you do not pay ATAK DOMAIN the renewal fees during the Renewal Grace Period, your domain name will be suspended and scheduled for deletion. Thereafter, provided the domain name is not subject to an expired domain auction and you pay ATAK DOMAIN’s redemption fee, you may have up to 30 days to recover your domain name.

The redemption fee will be displayed at the time of payment and is subject to change under the terms of this Agreement. If you do not redeem your domain name before the end of the 30-day redemption period, ATAK DOMAIN may, at its sole discretion, delete the domain name or transfer it to another domain holder on your behalf. During the redemption period, your domain name may be parked.

In the event your domain name is deleted, the Registry may provide a 30-day Redemption Grace Period during which you may continue to use your domain name by paying ATAK DOMAIN the applicable redemption fee. The redemption fee will be displayed at the time of payment and is subject to change under the terms of this Agreement. If you do not redeem your domain name by the end of the Registry’s Redemption Grace Period, your domain name will be released by the Registry and made available for registration by any party on a first-come, first-served basis.

The length of the Renewal Grace Periods and Redemption Grace Periods may vary for different ccTLDs. Please refer to the specific terms for the relevant TLD. In the event of any inconsistency between the provisions of this paragraph and the ccTLD-specific terms, the ccTLD-specific terms shall prevail.

3.2 FREE PRODUCT TERMS

If you receive free products together with the registration of a domain name, you acknowledge and agree that such products may be used only in connection with a valid purchase and may be terminated if the domain name is deleted or cancelled. For free domain names, you acknowledge and agree that you will not change the account associated with that free domain for a period of five (5) days after registration. If a free domain name is offered together with the registration of another domain name and the paid domain registration fails for any reason, we may, at our sole discretion, either delete the registration of the free domain name or refund the difference between the amount paid and the value of the free domain name. Failed registrations in connection with promotional offers may, at our discretion, result either in the deletion of the free or discounted product or in a reconciliation between the price of the registered domain and the value of the discounted product.


3.3 TERM OF AGREEMENT AND TRANSFERS

The terms and conditions of this Agreement shall remain in full force and effect for as long as you hold any domain name registered through ATAK DOMAIN.

You agree not to transfer any domain name registered with ATAK DOMAIN to another domain name registrar during the first sixty (60) days following the initial registration date. You acknowledge that you cannot transfer any domain name during the ten (10) days following an Account Change.

You further acknowledge and agree that you will not use the ability to cancel a domain name within three (3) days of registration with a full refund of the registration fee as a means of conducting “domain tasting” or similar activities by testing the marketing or operational advantages of a domain name. If ATAK DOMAIN, in its sole discretion, determines that you are engaged in “domain tasting”, ATAK DOMAIN reserves the right to (a) charge you a small fee (which will be deducted from any refund) or (b) reject your cancellation/refund request entirely. If ATAK DOMAIN cancels your domain name during the three (3) day period without payment due to fraud or other circumstances beyond your control, ATAK DOMAIN will not charge you any fee. The three (3) day initial use period does not apply to Premium Domain Names for which the registration fee is non-refundable.

Express Consent for Domain Name Transfer and Conditions under Which Transfer May Be Prohibited

The Registered Domain Name Holder acknowledges that, for a request to transfer the domain name to another registrar or person to be processed, his/her explicit and verifiable consent must be obtained.

In the following circumstances, a domain name transfer may be blocked or rejected by the Registry Operator:

  • If 60 days have not elapsed since the initial registration of the domain name,
  • If the domain name is subject to any legal dispute or court order,
  • If any action in relation to the domain name is found to be in violation of ICANN policies or the policies of the relevant Registry,
  • If an attempt is made to transfer the domain name fraudulently or without authorization,
  • If there is a payment dispute or enforcement proceedings in relation to the domain name.

The Registered Domain Name Holder hereby agrees in advance that the transfer request may be rejected if any of the above conditions exist.


3.4 RESPONSIBILITY FOR UPDATING INFORMATION

You agree to notify ATAK DOMAIN within five (5) business days of any changes to the information you provided as part of the application and/or registration process. It is your responsibility to ensure that the information remains accurate and up to date. Failure to provide accurate and reliable information initially and on an ongoing basis for any reason shall constitute a material breach of this Agreement and may be a basis for the suspension and/or cancellation of your domain name registration. Likewise, failure to respond within five (5) business days to any inquiry made by ATAK DOMAIN for the purpose of verifying the accuracy of the information you have provided shall also constitute a material breach of this Agreement and may be a basis for the suspension and/or cancellation of your domain name registration. You agree to keep a copy of the receipt as proof of purchase of your domain name.

You acknowledge that the following contact information is required for each domain name you register: postal address, email address, telephone number and the same contact information for the technical, administrative and billing contacts.

You acknowledge and agree that, for the purpose of domain name management, your contact information may be used, copied, distributed, published, modified and otherwise processed and shared with the Registry Operator, including the cross-border transfer of such data (for example, between the USA and the EU). Such information may be made publicly available by the Registry Operator through the WHOIS or a proxy protocol (collectively, the “WHOIS Directory”), as required by ICANN requirements or the requirements of certain ccTLDs (.am, .au, .com.au, .net.au, .org.au, .ca, .cz, .fr, .it, .jp, .co.jp, .kr, .co.kr, .ne.kr, .re.kr, .no, .co.nz, .net.nz, .org.nz, .vg, .se, .so, .sg, .com.sg, .tw, .com.tw, .net.tw, .org.tw, .uk, .co.uk, .me.uk, .org.uk, .us). This publication is beyond the control of ATAK DOMAIN and is not subject to its direction.

ATAK DOMAIN and the Registry Operator may be required to archive this data with a third-party escrow service. By this Agreement, you consent to and authorize all such requirements and disclosures. If you provide information about a third party, you represent and warrant that you have informed the third party of such disclosure and its purposes and have obtained the third party’s consent to such disclosure. The Domain Name Registrar will not process such data in a manner inconsistent with this Agreement and will take reasonable measures to protect the data against loss or misuse.

You acknowledge that, for each domain name you register, the following information will be made publicly available in the WHOIS Directory to the extent required by ICANN or registry policies:

  • Domain name;
  • Your name and postal address;
  • Name, email address, postal address, telephone and fax numbers for technical and administrative contacts;
  • Internet Protocol numbers for the primary and secondary name servers;
  • The corresponding names of the name servers; and
  • The initial registration date and expiration date;
  • The names of the primary and secondary name servers; and
  • The identity of the domain name registrar.

You acknowledge and agree that, to the extent permitted by ICANN, ATAK DOMAIN may use the publicly available information you provide during the registration process. If you engage in the resale of domain names to individuals from whom you collect personal data, you agree to provide such individuals with information regarding the possible uses of their personal data in accordance with ICANN policy. You also agree to obtain the consent of such individuals to such uses of their data and to retain evidence of such consent.

You acknowledge that ATAK DOMAIN has the right to publicly disclose and share certain information regarding the purchase and sale of domain names on its website, including, but not limited to: (a) the name of the domain name sold or acquired, (b) the price of the domain name sold or acquired, and (c) the time of sale or purchase.

In order to enable us to comply with existing or future rules or policies, including those adopted by CIRA or any provincial or state authority having rulemaking and policy-making jurisdiction, you hereby grant us the right to disclose to third parties, via an interactive and publicly accessible registration database, the following information which you are required to provide when applying for a domain name:

  1. The domain names and subdomains registered by you;
  2. The name, type and postal address of your organization;
  3. The names, positions, postal addresses, email addresses, telephone and fax numbers (if any) of the technical and administrative contacts for your domain name or subdomains;
  4. The full hostnames and Internet Protocol (IP) addresses of at least two name servers (one primary and at least one secondary) for your domain name or subdomain. Up to six (6) name servers may be listed. If a host has more than one IP address, use a comma-separated list;
  5. The corresponding names of these name servers;
  6. The date on which the registration was first created; and
  7. The date on which the registration is due to expire.

This information may be made available in aggregate form for third-party use. We may also transfer or assign such information to CIRA or another third party at our discretion.



3.5 DOMAIN NAME DISPUTES

3.6 YOUR OBLIGATIONS, SUSPENSION OF SERVICES, BREACH OF AGREEMENT

You represent and warrant that, to the best of your knowledge, the registration or direct or indirect use of your domain name does not infringe the legal rights of any third party. You agree to comply with all applicable laws, including, but not limited to, those relating to privacy, data collection, consumer protection, fair credit, debt collection, organic farming, data disclosure and financial disclosures. If you collect and maintain health-related or financial data, you must implement reasonable and appropriate security measures proportional to the services provided, as defined by applicable law. You represent that you possess the necessary authority, privileges, licenses and/or other relevant credentials to participate in the sector related to the relevant registry TLD string. You agree to notify of any material changes affecting the validity of your authority, privileges, licenses and/or other relevant credentials. You agree to indemnify and hold harmless the Domain Name Registrar and the Registry Operator, as well as their directors, officers, employees and agents, from and against all claims, damages, liabilities, costs and expenses (including reasonable legal fees and costs) arising out of or related to your domain name registration. This obligation shall survive the expiration or termination of this Agreement or your domain name registration.

In addition to the other events set forth in this Agreement, you also acknowledge and agree that:

  1. Your use of all services provided by ATAK DOMAIN is subject to cancellation or suspension if there is an unresolved breach of this Agreement, or if any applicable ICANN policy (now existing or hereafter adopted) requires the suspension or cancellation of a domain name registration;
  2. Any of your domain name registrations may be subject to suspension, cancellation or transfer (a) by ATAK DOMAIN or the Registry Operator to correct mistakes made in domain name registrations or (b) pursuant to any specification or policy adopted by ICANN for the resolution of domain name disputes, or any ATAK DOMAIN procedure consistent with such specifications or policies;
  3. If ICANN and other relevant registries or dispute resolution providers (such as UDRP/URS, etc.) or competent judicial or administrative authorities order the cancellation, suspension, transfer or locking of the domain name or the suspension of its DNS resolution, the Registrar shall technically implement such decisions as notified to it, and no compensation of any kind may be claimed from the Registrar for any direct or indirect damages or loss of data that customers may incur as a result of these actions.
  4. Authority to Block Domain Access in Case of Fraud
    In the event of a court order or strong indication that the User is engaged in fraud, identity theft, trademark infringement or other illegal activity, Atak Domain shall have the right to suspend the domain or block access to it. In such circumstances, actions may be taken without prior notice to the User.

You acknowledge and agree that ATAK DOMAIN and the Domain Name Registrar, in their sole and absolute discretion, reserve the right to reject, cancel or transfer any registration or transaction, or to place any domain name on hold, lock, suspend or similar status as they deem necessary: (i) to comply with specifications adopted by any industry group generally recognized as an authoritative body with respect to the Internet; (ii) to correct mistakes made in connection with a domain name registration or to maintain the accuracy and integrity of the domain name registry; (iii) in the event of non-payment of fees owed to the Domain Name Registrar; (iv) to protect the integrity and stability of the Domain Name Registrar; (v) to comply with any applicable court orders, laws, government rules or requirements, legal requests or dispute resolution processes; (vi) to comply with the terms, conditions, rules and regulations of ICANN, including, without limitation, the Registration Agreement; (vii) to avoid any civil or criminal liability on the part of the Registry Operator and its affiliates, subsidiaries, officers, directors and employees; (viii) as otherwise provided in this Agreement; (ix) upon the occurrence of any unauthorized activities described in Section 8 below; or (x) during the resolution of a dispute.

Your failure to comply fully with the terms and conditions of this Agreement or any ATAK DOMAIN rule or policy shall constitute a material breach of this Agreement. ATAK DOMAIN may notify you of such breach in writing or electronically (by email). If you fail to provide ATAK DOMAIN with substantial evidence that you have not breached your obligations to ATAK DOMAIN within ten (10) business days, ATAK DOMAIN may terminate its relationship with you and pursue any available remedies in accordance with applicable law. Such remedies may be applied without notice and may include, without limitation, the cancellation of any of your domain name registrations and the termination of services provided to you by ATAK DOMAIN. If your Services are cancelled or terminated due to breach, you shall not be entitled to any refund.

ATAK DOMAIN’s failure to act or notify you regarding any activity that constitutes a breach shall not be deemed a waiver of the breach and shall not be construed as an excuse for such breach.


3.7 LIMITATION OF SERVICES, RIGHT TO REFUSE SERVICE

If your domain name is hosted on ATAK DOMAIN DNS servers, or if you use our systems to forward a domain name, URL or other content to a system or site hosted elsewhere, or if your domain name is registered with ATAK DOMAIN, it is your responsibility to ensure that there is no excessive load on ATAK DOMAIN servers in connection with your domain. You may not use ATAK DOMAIN servers and your domain name as a source, intermediary, reply-to address or destination address for email attacks or any other attacks. Server hacking and other security breaches are prohibited. If ATAK DOMAIN determines that your site is engaged in activities that threaten network stability, ATAK DOMAIN reserves the right to disable your domain name from its DNS servers.

You acknowledge that ATAK DOMAIN, in its sole discretion and without any liability to you, may refuse to accept the registration of any domain name. ATAK DOMAIN may also, in its sole discretion and without any liability to you, delete any domain name registration within the first thirty (30) days following its initial registration.

If ATAK DOMAIN refuses a registration or deletes an existing registration within the first thirty (30) days after registration, you will receive a refund of all fees paid to ATAK DOMAIN in connection with the cancelled or rejected registration. No refund will be given if ATAK DOMAIN deletes a domain name registration used in connection with spam, gambling or other morally objectionable activities.

4.1 SPECIAL PROVISIONS FOR .TRAVEL REGISTRATIONS

To register a .TRAVEL domain name, the domain name holder must be engaged in, or plan to engage in, the provision or offering of services, products or content in the travel industry or related to the travel industry.

4.2 SPECIAL PROVISIONS FOR .REISE REGISTRATIONS

Domain names registered as .REISE must be used for travel-related purposes, e.g., to provide a function or to be used on the Internet, within six months of the initial registration date.

4.3 SPECIAL PROVISIONS FOR .SEXY REGISTRATIONS

You shall not permit content that is unsuitable for viewing by minors to be displayed from the root or top-level directory of a .SEXY domain. For clarity, content displayed in the root or top-level directory of a .SEXY domain is content that is immediately visible when a user navigates to http://exampledomain.sexy or http://www.exampledomain.sexy. No restriction is imposed on content that is located on other pages or in subdirectories of a .SEXY Registered Name.

  1. COUNTRY-CODE TOP-LEVEL DOMAINS

You represent and warrant that you meet the eligibility requirements for each ccTLD to which you apply. You further agree to be bound by all registration rules, policies and agreements applicable to the relevant ccTLD. These requirements include, but are not limited to, agreeing to indemnify the ccTLD provider, limiting the liability of the ccTLD provider, and agreeing that disputes will be resolved in accordance with the laws of the relevant country.

5.1  SPECIAL PROVISIONS FOR .AU DOMAIN REGISTRATIONS
.au registrations (including .au, com.au, net.au and org.au) are governed by the following additional terms and conditions:

auDA. “auDA” means .au Domain Administration Limited ACN 079 009 340, the administrator of .au domain names. The Domain Name Registrar acts as an agent of auDA solely to the extent necessary to enable auDA to benefit from the rights and protections conferred upon it under this Agreement. auDA is a third-party beneficiary of this Agreement.

auDA Published Policies. “auDA Published Policies” means the specifications and policies from time to time established and published by auDA on its website, https://www.auda.org.au. The auDA Published Policies are incorporated into and form part of this Agreement and you must comply with all of them. In the event of any inconsistency between any provision of this Agreement and any auDA Published Policy, the auDA Published Policy shall prevail to the extent of the inconsistency. Under the auDA Published Policies you acknowledge that: (1) mandatory terms and conditions apply to all domain names; (2) these terms and conditions are incorporated into this Agreement and form part of it; (3) you are subject to and must comply with the .au Dispute Resolution Policy; and (4) auDA may delete or cancel a .au domain name registration.

auDA’s Liability and Indemnity. To the maximum extent permitted by law, auDA shall not be liable to the Domain Holder for any direct, indirect, consequential, special, punitive or exemplary loss or damage (including, without limitation, loss of use, loss of profits, corruption of user data, interruption of business or incidental costs) which the Domain Holder may suffer arising from or in connection with any act or omission of auDA, its employees, agents or contractors. The Domain Holder agrees to indemnify and keep indemnified auDA, its employees, agents and contractors from and against any claim or liability arising out of or in relation to the Domain Holder’s registration or use of a .au domain name. Nothing in this document is intended to exclude the operation of the Trade Practices Act 1974.

5.2  SPECIAL PROVISIONS FOR .CA DOMAIN REGISTRATIONS
You acknowledge and agree that your selected domain name will not be registered upon your initial application to CIRA unless and until you become a party to and agree to be bound by CIRA’s Registrant Agreement.

CIRA-Certified Domain Name Registrar. If the Domain Name Registrar ceases to be a CIRA Certified Registrar, has its certification suspended or terminated, or if the Registrar Agreement between CIRA and the Domain Name Registrar is terminated or expires, the Domain Name Registrar shall promptly notify you. CIRA may post a notice of such suspension, termination or expiration on its website and, if it deems appropriate, may notify the affected domain name registrants. If the Domain Name Registrar ceases to be a CIRA Certified Registrar, has its certification suspended or terminated, or if the Registrar Agreement between CIRA and the Domain Name Registrar is terminated or expires, it is your responsibility to transfer your domain names to a new CIRA Certified Registrar within thirty (30) days from the date on which notice is given to you by either the Domain Name Registrar or CIRA in accordance with CIRA’s then-current Registrant PRP, except where the term of any of your domain name registrations is scheduled to expire within thirty (30) days of such notice; in that case, you have thirty (30) days from the anniversary date of the registration to select a new CIRA Certified Registrar and renew such registration in accordance with the Registrant PRP.

You acknowledge and agree that if there are insufficient funds in the CIRA Deposit Account used by the Domain Name Registrar to pay fees, CIRA may, in its sole discretion, stop accepting domain name applications from that Domain Name Registrar, stop processing registrations, transfers, renewals, changes and deletions of domain names requested by that Domain Name Registrar and stop processing any other chargeable transactions requested by that Domain Name Registrar. CIRA may also terminate the Registrar Agreement between CIRA and the Domain Name Registrar.

.CA ASCII and IDN Domain Variants. ASCII and IDN variants of .CA domains are bundled and reserved for a single domain holder. A domain holder is not required to register all variants in a bundle; however, all registered variants must be managed through a single Domain Name Registrar. A separate registration fee applies to each registered variant. In addition, when registering multiple .CA domains (ASCII and IDN) within a single bundle, your domain holder information must be identical. If variants are registered with different Domain Name Registrars or the domain holder information does not match, this may result in an “unavailable” search result, delays or registration failures. If the information does not match, a verification process is required, which may take up to seven business days and delay the availability of the domain name.

5.3  SPECIAL PROVISIONS FOR .CN DOMAIN REGISTRATIONS
The .CN extension is a restricted TLD, which means that applications are subject to both domain control and real-name verification as required by the Government of the People’s Republic of China. Accordingly, .CN registrations are subject to the following additional terms:

Verification, Registration and Activation. If the Government of China does not permit the registration of a domain name, or if we, the Registry Operator and/or any third-party provider engaged by us for such services (in their or our sole discretion) determine that the registration is not permitted, the registration application will not be successful. In such a case, the domain name will be deleted and you may be eligible for a refund as described below.

If the registration is permitted, the registration process may proceed; however, if you do not submit the valid documents requested by us and the Registry Operator (as explained during the registration process), the .CN domain name may not be activated (i.e. may not be usable on the Internet). The following are the forms of documents accepted for verification:

    1. China: Residence permit, temporary residence permit, business license or organization code certificate
    2. Hong Kong/Macau: Residence permit, driver’s license, passport or business license
    3. Singapore: Driver’s license, passport or business license
    4. Taiwan: Residence permit, driver’s license or business license
    5. Other Countries/Regions: Driver’s license or passport

Documents submitted to us are used solely for the purpose of real-name verification and are shared with the Domain Name Registrar only for that purpose and are subject to our Privacy Policy available at https://www.atakdomain.com/gizlilik-politikasi. By registering a .CN domain name, you expressly acknowledge and agree that your data may be stored on servers located in the United States or on servers located outside the People’s Republic of China.

Refunds. Refunds for .CN registrations are permitted only (i) if the Government of China does not permit the registration of the domain name; or (ii) if, for any reason, you notify us of your intention to cancel the registration within the first five (5) days after registration (that is, after the Government of China has approved the registration). For the avoidance of doubt, no refund shall be permitted after five (5) days from the registration date under any circumstances, including, without limitation, if real-name verification is not successfully completed or if, after registration, the Government of China decides not to approve the domain name registration (and directs us to delete the domain name).

5.4 SPECIAL PROVISIONS FOR .JP DOMAIN REGISTRATIONS
Registration Restrictions. You represent and warrant that you have a residential or business address in Japan. You acknowledge that certain domain names are reserved and may be registered only by specific parties. These include: (i) TLDs other than ccTLDs designated by ICANN; (ii) geographic .JP domain names defined as labels for metropolitan, prefectural and municipal authorities; (iii) names of first- and second-level educational institutions; (iv) names of organizations related to Internet governance; (v) domain names necessary for .JP domain operations; and (vi) character strings that may be confused with Japanese domain names represented in ASCII code.

5.5 SPECIAL PROVISIONS FOR .UK (UNITED KINGDOM) DOMAIN REGISTRATIONS
