No. Article 4 of the Naming Charter opens allocation to every applicant «whether Haitian or not, whether legally present in Haiti or not». com.ht also does not appear on the list of zones that require documents — that list holds only edu.ht, gouv.ht, rel.ht, med.ht and coop.ht.
